Forte des échos positifs reçus par le rapport « Archives orales » remis à la Mission de recherche Droit et Justice en 2018 (cf. le journal Le Monde, les articles dans Dalloz Actualités et les connexions en hausse sur son site internet, grâce au lien dédié aux vidéos réalisées), l’AFHJ a décidé de proposer un nouveau projet. Celui-ci n’a pas pour ambition de faire une histoire de la justice à partir de sources écrites, mais de permettre la mise en récit, par ses acteurs, de l’institution judiciaire et de ses évolutions contemporaines ; il s’agit d’assurer la collecte, la conservation et la valorisation des témoignages de magistrats acteurs de la justice du XXe siècle. Le corpus se compose de treize magistrats (hommes et femmes) sélectionnés en fonction de critères multiples (tels que l’âge, le type de parcours professionnel, les engagements, etc.). Tous ont en commun d’avoir rencontré l’histoire au cours de leur carrière et d’être en capacité d’en tirer une réflexion sur l’acte de juger ; ils constituent la mémoire vivante de l’institution judiciaire. Le récit de carrière est privilégié car il permet de combiner diverses approches : biographique, centrée sur l’identité du témoin, sa formation et sa trajectoire ; organisationnelle et juridique, intégrant les évolutions contemporaines de l’institution et de ses pratiques ; événementielle, en imbriquant approche sectorielle et contextuelle par la mise en résonance de la mémoire du témoin et de la chronologie des situations (nationale, européenne, etc.). Les entretiens menés sont semi-directifs, technique qualitative qui permet de centrer le discours des personnes interrogées autour de thèmes préalablement définis, tout en leur laissant une grande liberté dans l’évocation de leurs souvenirs et la formulation de leurs réponses. Cette technique souple balise le territoire de l’interview sans enfermer le propos du témoin ; en même temps, les propos sont confrontés aux sources écrites disponibles, ce qui nourrit la discussion avec les témoins. Dans un contexte de questionnements sur le devenir de l’institution judiciaire, ce projet espère contribuer à alimenter la réflexion collective en mettant à la disposition des chercheurs et du public un corpus unique : des témoignages oraux inédits tirés de l’expérience vécue des acteurs de la justice du XXe siècle.

With the positive echoes received by the « oral archives » report submitted to the Mision de recherche Droit et Justice in 2018 (cf. Le Monde newspaper, articles in Dalloz Actualités and increasing connections on its website, thanks to the link dedicated to the videos made), the AFHJ decided to propose a new project. It is not his ambition to make a history of justice from written sources, but to enable his actors to tell the story of the judicial institution and its contemporary evolutions; it is a question of ensuring the collection, conservation and valorization of the testimonies of magistrates involved in the justice of the twentieth century. The corpus consists of thirteen magistrates (men and women) selected according to multiple criteria (such as age, type of career, commitments, etc.). All have in common that they have encountered history during their careers and are able to draw from it a reflection on the act of judging ; they are the living memory of the judicial institution. The career narrative is privileged because it allows to combine various approaches : biographical, centered on the identity of the witness, its formation and its professional trajectory ; organisational and legal, integrating the contemporary developments of the institution and its practices ; event, by combining sectoral and contextual approach by resonating the memory of the witness and the chronology of situations (national and european). The interviews conducted are semi-directional, qualitative technique that allows to centralize the speeches of the people interviewed around previously defined themes, while leaving them a great freedom in the evocation of their memories and the formulation of responses. This flexible technique tag the territory of the interview without locking up the witness’s comments; At the same time, the remarks are confronted with available written sources, which feeds the discussion with witnesses. In a context of questions on the future of the judicial institution, this project hopes to contribute to the collective thinking by putting at the disposal of the researchers and the public a unique corpus: unpublished oral testimonies drawn from the experience of the actors of justice of the twentieth century.
